Terms and Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you and SynaptechVerse LLP, a limited liability partnership incorporated under the Limited Liability Partnership Act, 2008 and registered in Pune, Maharashtra, India ("SynaptechVerse", "we", "us" or "our"). SynapGameVerse is a product of SynaptechVerse LLP, and we operate the website and web application available at synapgameverse.com (together, the "Service"). By creating an account, accessing or using the Service, you accept these Terms, our Privacy Policy and our Refund and Cancellation Policy, each of which is incorporated into these Terms by reference. If you do not agree, please do not use the Service.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made thereunder. They do not require a physical or digital signature.

1. The Service

SynapGameVerse is a browser-based motion gaming platform. Players use their device camera and on-device body-tracking technology to control games with physical movement (for example jumping, stretching, balancing and yoga poses). The Service includes game content, activity plans, performance dashboards, and administrative consoles for registered organisations such as schools and senior-living facilities.

2. Eligibility and Accounts

• To register an account on your own behalf you must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872.
• Accounts for persons under 18 ("children") must be created and supervised by a parent or legal guardian, or provisioned by a registered organisation (such as a school) that has obtained the consent required by applicable law. The parent, guardian or organisation accepts these Terms on the child's behalf and remains responsible for the child's use of the Service.
• You agree to provide accurate, current and complete registration information and to keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorised use.
• We may refuse, suspend or terminate accounts that violate these Terms or applicable law.

4. Licence to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes (or, for organisations, for internal educational or wellness purposes under the organisation's plan). You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, frame or create derivative works of any part of the Service except as permitted by law.

5. Free Tier, Subscriptions and Payments

• The Service offers a free tier with daily or monthly play limits, and paid subscription tiers (currently "Pro" and "Pro Max") that remove those limits and add features. Current prices, inclusions and billing periods are displayed inside the Service at the point of purchase.
• All prices are in Indian Rupees (INR) and, unless stated otherwise, are inclusive of applicable taxes such as GST.
• Payments are processed by our authorised payment gateway partner (Razorpay Software Private Limited). We do not collect or store your card, UPI or bank credentials. Your use of the payment gateway is also subject to the gateway's own terms.
• Subscriptions are for the period purchased. Unless we expressly enable and you expressly authorise automatic renewal (for example UPI Autopay), subscriptions do not auto-renew: access to paid features simply ends when the period expires and you may renew manually.
• Cancellations and refunds are governed by our Refund and Cancellation Policy.
• We may change prices or plan inclusions prospectively. Price changes never affect a period you have already paid for.

6. Organisation (School and Institution) Accounts

• Organisations may register to provision and manage accounts for their students, residents or members ("managed users").
• The organisation represents and warrants that it has the legal authority, and has obtained all consents required under applicable law (including verifiable parental consent for children under the Digital Personal Data Protection Act, 2023), to create and manage accounts for its managed users.
• Organisation administrators and co-administrators are responsible for the accuracy of managed-user data, for keeping credentials confidential, and for the conduct of their managed users on the Service.
• Trial periods, pricing and invoicing for organisations are as agreed at onboarding or as displayed in the organisation console.

7. Coins, Badges and Virtual Items

Coins, badges, ranks, streaks and other in-game items are virtual features with no monetary value. They are not currency, cannot be purchased separately, exchanged, transferred, redeemed for cash or refunded, and may be adjusted, reset or discontinued at our reasonable discretion (for example to correct errors or prevent abuse).

8. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• attempt to gain unauthorised access to the Service, other accounts, or our systems, or probe, scan or test their vulnerability without written authorisation;
• manipulate scores, coins or leaderboards through automation, tampering or exploits;
• upload or display unlawful, obscene, defamatory, hateful or infringing content through any feature that accepts user content;
• impersonate any person, misrepresent your affiliation, or create accounts with false information;
• interfere with or disrupt the Service, including by transmitting malware or placing unreasonable load on our infrastructure; or
• resell, sublicense or commercially exploit the Service without our written agreement.

9. User Content

Certain games allow players to select their own media (for example images) from their device for use during play. Such media is processed locally in your browser only, is not uploaded to our servers, and remains your sole responsibility. You must have the right to use any content you select, and you must not use content that is unlawful or inappropriate for the audience present.

10. Intellectual Property

The Service, including its games, software, 3D models, artwork, characters (including "Mayur" the peacock), text, design, trademarks and logos (including the SynapGameVerse name and mark), is owned by or licensed to SynaptechVerse LLP and is protected by copyright, trademark and other intellectual property laws of India and other jurisdictions. Except for the limited licence in Section 4, no rights are granted to you. Third-party components remain subject to their own licences.

11. Third-Party Services

The Service integrates third-party services, including Google sign-in, payment processing by Razorpay, and pose-tracking runtimes delivered from third-party content networks. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for third-party services we do not control.

12. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or compatible with every device, camera or browser, or that body tracking will be accurate in all lighting and space conditions.

13. Limitation of Liability

To the maximum extent permitted by applicable law: (a) SynaptechVerse LLP shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or anticipated savings, arising out of or relating to the Service; and (b) our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the greater of (i) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (ii) INR 1,000.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including your statutory rights as a consumer under the Consumer Protection Act, 2019.

14. Indemnity

You agree to indemnify and hold harmless SynaptechVerse LLP, its partners, employees and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.

15. Suspension and Termination

You may stop using the Service at any time and may request deletion of your account as described in the Privacy Policy. We may suspend or terminate your access, with or without notice, if you materially breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 10, 12, 13, 14 and 16) shall survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to any mandatory consumer-protection rights you may have, the courts at Pune, Maharashtra, India shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service. 17. Changes to These Terms

We may update these Terms from time to time. The "Effective date" above reflects the latest revision. Material changes will be notified through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
